Envizia AI is a product and service of Strata Mixed Reality Inc. (“Strata,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of Envizia.ai and related services (the “Service”). By using Envizia, you agree to these Terms and our Privacy Policy.
1. Eligibility and Accounts
You must be at least 18 years old to use Envizia. You are responsible for maintaining your account security and for all activity occurring under your credentials. You must provide accurate, current information and keep it updated.
2. Purchases, Credits, and Subscriptions
All purchases are made from Strata via Stripe. Charges will appear as Envizia by Strata. Credits have no cash value, are non-transferable, and expire 12 months after purchase or plan cancellation unless otherwise required by law.
Refunds are issued only for verified billing errors or where required by law. Subscription plans renew automatically unless canceled at least five (5) days prior to the renewal date.
3. Prohibited Content and Conduct
You may not use Envizia to generate, distribute, or promote:
- Illegal or infringing material, including violations of intellectual property, privacy, or publicity rights, or deepfakes of real people without consent.
- Hate, harassment, threats, or content that promotes or glorifies violence or discrimination.
- Pornographic or sexually explicit imagery or any content exploiting or endangering minors.
- Deceptive, fraudulent, or misleading representations, including phishing or scams.
- Impersonation, disinformation, or content intended to materially mislead viewers.
Strata may restrict, suspend, or terminate accounts for violations.
4. Fair Use and Resource Protection
Envizia is designed for normal creative and production workflows. To ensure reliability and equitable access for all users, Strata monitors usage patterns for activity that may place disproportionate load on system resources or indicate automated, exploitative, or non-typical use of the Service.
Strata may review accounts exhibiting behaviors including, but not limited to:
- Sustained or continuous consumption of generation actions in patterns that create disproportionate infrastructure costs relative to the plan value purchased.
- Usage patterns inconsistent with typical human creative workflows, such as large-volume or near-continuous generation activity.
- Exclusive or near-exclusive use of specific features in a manner that materially exceeds normal usage expectations for the subscription tier.
- Use of scripts, automation tools, bots, or similar mechanisms to initiate generation requests in an automated fashion.
- Attempts to circumvent metering, credit accounting, rate limits, or usage tracking mechanisms.
If such activity is detected, Strata may, at its sole discretion:
- Request clarification regarding intended usage;
- Temporarily throttle or limit access to certain features;
- Recommend or require migration to a higher-capacity plan; or
- Suspend or terminate access to the Service.
Normal good-faith usage will not be affected. This policy is intended solely to prevent abusive or exploitative consumption that threatens service stability or results in operational costs materially exceeding the value of the plan purchased.
5. Ownership of Generated Outputs
You own the images, videos, and other assets you generate through Envizia (“Outputs”) to the fullest extent permitted by law. Subject to applicable law and third-party rights (including trademarks, copyrighted characters, and rights of publicity), you may use your Outputs for any lawful purpose, including commercial use in web, print, advertising, broadcast, packaging, client work, and other media.
Envizia/Strata does not claim ownership of your Outputs. Copyright protection for AI-generated content may vary by jurisdiction, and you are responsible for ensuring compliance with applicable laws and for obtaining any permissions required for your specific use.
Strata retains a limited, perpetual, royalty-free license to store and use anonymized, non-identifying copies of Outputs and associated metadata solely for analytics, service optimization, and product improvement.
6. Copyright and DMCA
Strata respects intellectual property rights. To report infringement, send a DMCA-compliant notice to legal@strata.com (Strata Mixed Reality Inc., Legal Department). Your notice must include: identification of the work infringed; the allegedly infringing material (URL or sufficient detail); your contact information; a statement of good-faith belief that the use is not authorized; and a statement under penalty of perjury that the information is accurate and that you are authorized to act. A physical or electronic signature is required.
7. Availability and Modifications
We aim for reliable operation but do not guarantee uninterrupted service. Maintenance and updates may occur without notice. Features may change or be discontinued; purchased credits remain valid or refundable only as stated in Section 2. Strata reserves the right to modify the Service at any time, including changing features, pricing, credit costs, plan structures, or discontinuing any aspect of the Service without prior notice or liability.
8. Limitation of Liability
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). Strata does not guarantee the quality, consistency, stability, uptime, or reliability of the Service or any generated outputs. To the maximum extent permitted by law, Strata’s total liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to Strata in the twelve (12) months before the claim or (b) USD $100. Strata will not be liable for any indirect, incidental, special, consequential, or punitive damages.
9. Dispute Resolution and Arbitration
These Terms are governed by Utah law. Any dispute will be resolved by binding arbitration in Washington County, Utah, under the rules of the American Arbitration Association. You and Strata waive any right to a jury trial or to participate in a class action. Either party may seek injunctive relief in Utah courts to protect intellectual-property rights.
10. Governing Law
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-laws principles.
10A. International Users and GDPR Compliance
Envizia is operated by Strata Mixed Reality Inc. from the United States. If you access or use Envizia from the European Economic Area (EEA), the United Kingdom, or other regions with laws governing data collection and use, you consent to the transfer, storage, and processing of your information in the United States and other jurisdictions where our processors operate.
Strata complies with the principles of the EU General Data Protection Regulation (GDPR) and the UK GDPR. Where applicable, Strata acts as the data controller for user account, billing, and marketing data. Our processors (such as payment and infrastructure providers) act under written data processing agreements that meet GDPR requirements, ensuring appropriate safeguards for cross-border data transfers.
If you are located in the EEA or UK, you may contact privacy@strata.com to exercise your GDPR rights, including the right to access, rectify, erase, or restrict processing of your personal data.
11. Account Restrictions and Security
Each account is licensed for use by a single individual or the specific number of seats purchased. Account sharing, credential sharing, or simultaneous access from multiple users using a single account is prohibited. Strata may monitor account access patterns and terminate accounts found to be shared across multiple users.
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service or any part thereof. You may not use the Service to develop or offer competing products or services without Strata’s prior written consent.
12. Service Modifications and Technical Limitations
Strata reserves the right to modify, update, or discontinue any feature, functionality, or aspect of the Service at any time without prior notice. This includes changes to rendering algorithms, output styles, credit costs for specific actions, feature availability by plan tier, and user interface elements. We do not guarantee the quality, consistency, stability, uptime, or reliability of any generated outputs or Service features. You should not build critical business dependencies on any specific aspect of the Service or characteristics of generated assets.
Strata may apply rate limiting or usage throttling to maintain service quality and stability for all users. Purchasing any plan grants reasonable access to the Service subject to these Terms and our Fair Use policy.
13. Force Majeure
Neither party will be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, terrorism, riots, war, pandemics, government actions, internet service provider failures, or denial-of-service attacks.
14. User Suggestions and Feedback
If you provide Strata with any suggestions, ideas, enhancement requests, feedback, recommendations, or other input regarding the Service (“Feedback”), you hereby assign to Strata all rights in such Feedback and agree that Strata will have the right to use and fully exploit such Feedback in any manner, without compensation or attribution to you.
15. Export Control
You acknowledge that the Service may be subject to U.S. export control laws and regulations. You agree to comply with all applicable international and national laws that apply to the Service, including U.S. Export Administration Regulations, as well as end-user, end-use, and destination restrictions issued by U.S. and other governments.
16. Indemnification
You agree to indemnify, defend, and hold harmless Strata, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; (d) content you generate using the Service; or (e) any unauthorized access to or use of our servers arising from your account credentials.
